HD plans legal action over ‘low safety’ claim

HD FERRIES is today preparing to take legal action against Condor Ferries. It claims that a release published by Condor on 3 August, which stated that ‘professed low-cost operation cannot be allowed to deliver low safety services’, is defamatory.

The comment was made by Condor following the decision of Jersey Harbours to suspend HD Ferries’ ramp permit after a safety inspection by Port State Control.

HD Ferries chief executive officer Chris Howe-Davies said Condor’s remarks were unfounded.

‘The suggestion by Condor that our desire to offer low fares affects our ability to operate safely is entirely baseless,’ he said.

‘Our ship, HD1, has been managed from the outset by Northern Marine, a respected ship management company and wholly-owned subsidiary of StenaAB, one of the world’s largest ferry operators.

‘Our decision to retain such an established and experienced organisation underlines our intention to ensure that HD1 is operated entirely in accordance with best industry practice at all times,’ he said.

Mr Howe-Davies said his companies’ タタ11m. investment in HD1 demonstrated the scale of commitment to the market it serves.

‘We cannot allow our reputation to be harmed by the false statement made by Condor and so we feel compelled to take action to set the record straight,’ he said.

‘This action signals HD’s intention to vigorously defend the company’s right to compete on a fair and equal basis in the markets the company serves.

‘We’re simply looking for a level playing field on which to offer choice and low fares to the travelling public,’ he said.

Condor Ferries yesterday declined to comment on the possible action against it.
