Island provides ‘legal certainty’ with image rights legislation

IMAGE rights registrations in Guernsey could one day become part of ‘the essential tool kit’ for protecting the rights of celebrities and sports stars.
Elaine Gray, IP specialist at Carey Olsen, who moderated a panel discussion at Guernsey Finance’s launch event for image rights in London last month, said the event was positively received.
She added that it was important to reinforce that image rights registration should not be seen as a tax product, but other technical points on registration had been understood by the 200-strong audience of lawyers and agents.
‘The event will have helped us to move towards the critical mass of registrations and soon we hope people will regard this as being part of the essential tool kit for the protection of celebrities and sports stars,’ said Advocate Gray.

Very much doubt it.
I knew people who attended that London event and by all accounts they failed to sell the IP/image rights both from a practical or popularity angle following questions from the audience.
In sum, it’s toothless.

Another red herring…
I’d heard things went badly. Isn’t too surprising given that I’ve never found anyone that could clearly explain why the Guernsey proposition was so attractive. If I can’t gleam that most basic information from local lawyers then what hope does an image rights agent have of selling the concept to a client?

I take it that means having enough clients for it to be self advertising?
If that is the aim why not offer half a dozen ‘freebee deals’ to so called A-list celebs so that you can then say ‘if it’s good enough for Robin Van Persie /Eric Cantona /Nobbie Styles /Ross Allen’ then it’s good enough for anybody

It won’t work. Guernsey has no double tax treaties to mitigate the effect of foreign withholding taxes. Without those, Guernsey offers less than the likes of Luxembourg, Holland or Ireland. Furthermore, Guernsey is not recognised under the Madrid convention.
Its a very weak offering. Poorly thought out and I’m told that the presentation in London focused on the negatives rather than the few positives.
