Agency predicts change in law

THE age, gender and nationality will be removed from the CVs of Approved Personnel’s applicants following new UK legislation. Managing director Gina Le Prevost said that although the law did not apply in the Channel Islands, the change was necessary and would take effect from 1 October.

‘We have candidates who are domiciled in other jurisdictions in which this will apply who may be seeking work in Guernsey or Jersey,’ she said.

‘Likewise if any Guernsey or Jersey people wish to move to (EU) jurisdictions, then we have to omit this information as we may be in breach of confidentiality and effectively be breaking the law.’

Ms Le Prevost added that a revision of Guernsey’s law was needed to bring the island into the 21st century.

‘I think age, gender or nationality should not be taken into consideration when someone is applying for a job in Guernsey or anywhere else,’ she said.

‘If we want to be seen as a professional jurisdiction then we must be seen to be revamping our image.

‘I’d be amazed if the laws haven’t been changed in Guernsey in five years’ time.’

Senior industrial relations advisory officer Mike Mahy said he was not aware that excluding this information was standard practice in other jurisdictions.

‘All we have in Guernsey is sex discrimination legislation, not age and not race, although agencies may have their own policies and interpret the laws as they wish,’ he said.

Deputy Commerce and Employment minister Carla McNulty Bauer said it had no plans for a change in the law. ‘We wish to minimise the laws of regulation in Guernsey,’ she said.
