Hand over your takings, Law Officers tell kiosk owners

Saturday 2nd August 2008, 9:30AM BST.

0614795.jpgTHE States is threatening to confiscate takings from Pembroke Bay kiosk, it emerged yesterday. Owners Gary and Lynn de Carteret are defying an order from the Law Officers not to open their business.

In a letter to them, the Law Officers said receipts from the kiosk would be taken as damages by virtue of their unlawful entry onto the land. The de Carterets claim that the situation is the latest episode in a lengthy campaign of harassment against them by the States.

States Property Services said the de Carterets had failed to comply with the terms of their lease and had refused to sign it. But the couple argue that the offered lease related to concessionaires of States-owned kiosks and not a private one.

The Law Officers have instructed the couple to remove the kiosk and make the site good within a month. If they do not, the States will undertake the work and the de Carterets will be charged for it.  The Law Officers did not respond yesterday when asked by the Guernsey Press if they were aware that Treasury had accepted the de Carterets’ ground rent for the site for 2008.

I think it is disgusting that the De Carterets have to go through this. You would think that the Law Offices and ultimately the States that we elected would have something better to do with their time and OUR money. Nearly every popular beach in the Uk and N.Ireland have small kiosks like theirs and are allowed to hire out deck chairs and the like. Something is seriously wrong here and the De Carterets should sit their ground and maybe one of Guernsey’s advocates should take pity on them and fight their case in court free! They should also contact all the tabloids in the Uk and tell them the story of how are government are treating local people like them.
