Regulator to be probed over Landsbanki crisis

Friday 17th October 2008, 2:30PM BST.

0046745.jpgAN INQUIRY is to be launched into the regulator’s handling of the Landsbanki Guernsey crisis.

This follows the bank’s customers being left out-of-pocket after administrators announced an initial repayment of just 30p in every pound held on deposit.

Many savers questioned the role of the Guernsey Financial Services Commission after it emerged that Landsbanki Guernsey had sent more than £36m. to UK-based Heritable Bank, its sister company now in administration.

Asked by the Guernsey Press yesterday why, with the knowledge that banks in Iceland were on the verge of difficulties, Landsbanki Guernsey was allowed to send large sums of money to a fellow subsidiary of Iceland’s second-largest bank, GFSC director general Peter Neville (pictured) said: ‘You have asked for a comment on the actions taken by the commission in relation to Landsbanki Guernsey and Heritable Bank in the UK.

‘This raises the whole question of the commission’s approach to the regulation and supervision of Landsbanki Guernsey.

‘It is normal practice for a regulator to have an inquiry into its performance carried out following a major event such as this. I have therefore recommended to our commissioners, and they have agreed, that an independent person of undoubted standing and expertise should be appointed by the commissioners to conduct such an inquiry as soon as possible.’

Whilst an enquiry into the GFSC’s conduct is welcome, it has to be seen as trully indepependent. That will not be the case with the GFSC picking their own independent person, reporting back to them under their terms of reference !
No,what needs to be done is for the Policy Council to set up a proper investigation panel made up of independent people who are capable of thorough investigation and who are not afraid of asking searching questions of all those involved.
This panel should also investigate the role and actions of politicians in respect of the Landsbanki situation. The panel needs to have political teeth so it should be made of independent minded politicians assisteed by those with a knowledge of the financial sector.
What is needed is proper job, not a potential whitewash, and this is why a panel enquiry with the same sort of authority of a House of Commons Select Committee is what is needed.

    “Regulator to be probed…”

    Ha Ha Ha!

Personally, I hope they do it with a rusty old fire iron!!!

Nobody can convince this out of pocket Guernsey depositor that this disaster could not have been avoided by more strict oversight and control of operations by the appropriate body.

Landsbanki Guernsey customers, (many of whom are reported to have lost soo much) will undoubtedly join me in the cry -

“Never mind yapping about .. the inquiry which comes far too late anyway – Instead…. Focus on getting our money back!!.. 100% of it!! Not just 30%”

And remember… a display of weakness with regards to the supervision of banks in Guernsey and your effectiveness to obtain complete and proper compensation for depositors in such a situation as this one will not only hurt depositors.. it will also hurt the islands reputation…And a reputaion lost is not regained easily.

So, I for one suggest that you bite the bullet and do the right thing.

    Get us back our money!!
