Car boss was not a bully, employment tribunal rules

A COMPANY managing director has been vindicated after an employment tribunal found that he had not mistreated an employee.

Motor vehicle technician Neil Forman branded his former boss, Iain Carse, a bully at a tribunal during which he claimed he had been constructively dismissed by Spellbound Holdings Ltd, trading as Bougourd Ford.

But the tribunal panel disagreed with Mr Forman and ruled in favour of the company, stating that the employee had not been forced into resigning.

Mr Carse welcomed the panel’s findings.

‘We feel vindicated for a number of reasons, but mainly because I don’t like being called a bully,’ he said.

‘We do not bully staff here and in fact have a very good relationship with them. People should be a little bit more careful when they throw these strong terms around without any substance.’

The dispute centred on the company’s introduction of a new staff handbook, which Mr Forman had refused to sign.

Mr Forman claimed he had been bullied and harassed by management over the issue, stating that Mr Carse had made an ‘If you don’t want to sign, you know where the door is’ threat at a meeting with staff.

Mr Forman said he would be appealing the decision but would make no further comment.

    So Mr Carse says ‘If you don’t want to sign, you know where the door is’, at a meeting with staff.

    However, the Tribunal say that as it was not directed solely at Mr Forman, and therefore the employee had not been forced into resigning.

    I find that rather perverse. The staff were given an ultimatum and because all but Mr Forman signed and he didn’t, he was not forced into resiging.

    Which part of, ‘If you don’t want to sign, you know where the door is’, is ambiguous.

    What other option was he given by Mr Carse other than to ‘resign’!
