‘My sacking was unfair,’ jailed nurse tells tribunal
Wednesday 6th May 2009, 2:30PM BST.
A NURSE jailed for helping to try to con a bank out of $45m. is claiming that her sacking was unfair.
Vuyiswa Yoli, 57, yesterday took the Health and Social Services Department to a tribunal over the termination of her contract in December while she was in prison on remand.
Her advocate, Simon Guille, said: ‘Mrs Yoli was dismissed without the department following any procedure and that violated her employment rights.’
The claim was denied by HSSD, which argued she was unable to meet the contractual duties of her job.
Lisa Evans, for HSSD, said: ‘The contract was frustrated after she was unable to fulfil her contract obligations.
‘Based on information given to the department by police that she was likely to remain in custody, it was a reasonable decision to come to that the contract was frustrated.’
Mrs Yoli worked at the Princess Elizabeth Hospital from July 2006 until her arrest on 26 November.
She was jailed last month for eight months after admitting attempting dishonestly to obtain a money transfer by deception.
