Fight to keep marquee may lead to Royal Court appeal

AVANT GARDEN’S advocate said he would challenge the decision in court if the company was refused permission to keep its marquee at Sausmarez Manor.
The business has been trading from the site since July 2007, but it is now applying for retrospective planning permission to do so.
‘In the event of rejection, I will be issuing appeal proceedings in the Royal Court,’ said Advocate Roger Perrot, in a letter accompanying the application.
Avant Garden has had trouble finding permanent premises for several years.
It initially traded at Route de L’Eglise, Castel, before moving to a shop in Le Pollet.
It later moved to Valnord Hill where its shop was destroyed by fire in May 2006.
From October of that year to February 2007, it traded from a temporary marquee at Les Cotils.
That summer it moved its marquee to the terrace at the Town Markets, but at the end of June the Environment Department closed it down after four weeks.

I visit Guernsey twice a year and one of the things I look forward to is visiting Avent Garden marquee especially just before Christmas. I can not see that it is doing anyone any harm where it is.

It seems like a witch hunt to me. Cannot someone help the chap keep a Guernsey business going especially as it seems to be a business in demand. It was a wondeful shop when it was at Castel.
What is wrong with the authorities in Guernsey that no one seems big enough or kind hearted enough to say that they will help the gentleman keep his business up and running.
He helps Guernsey States out by paying his personal and business taxes to the benefit of everyone on Guernsey.
Sadly, from experience, I can tell you that Guernsey wants to collect tax from businesses but will not help the companies to become viable businesses by looking at, and helping small businesses to thrive (or survive even).

Yes, don’t the Environment Department have anything else to do? Leave him alone – it’s hardly a ‘permanent structure’, is it?
I presume that planning waiting lists are now so short that the beleaguered Environment Dept. are looking for work. Work like controlling hedges, fences, and approving more hideous (and permanent) buildings.

Would you all say the same if I ran my business out of a tent in my field?
I’d save a fortune in rent and TRP, and could put a few of my competitors out of business.
Yeh, let’s have a free-for-all on planning.
Why doesn’t he run it from Martel’s which is being closed down? It’s all about money and competitive advantage.
