GFSC vows to protect finance standards

NORTHERN Rock Guernsey could face regulatory action over allegations made by BBC’s Panorama, it has been revealed.

Director-general of the Guernsey Financial Services Commission Nik van Leuven issued a stern warning to the industry yesterday.

The ‘Tax Me If You Can’ programme on bad banking showed a Lloyds TSB Offshore banker in Jersey advising a client on how to route money through Hong Kong to avoid taxation and telling them it was of no interest to the bank if they told the tax man about income.

It also featured accusations that a Northern Rock Guernsey banker gave similar advice to a client.

‘The commission is acutely aware of the embarrassment to Jersey and Guernsey caused by Monday evening’s Panorama programme,’ Mr van Leuven said. ‘The commission’s position is simple – illegality will not be tolerated, nor will conduct which, whilst not unlawful, brings Guernsey into disrepute.

‘The commission requires high standards of conduct from all Guernsey’s financial services licensees.’

Mr van Leuven said Panorama had obviously edited the meeting with the Jersey Lloyds bank worker to be as damaging as possible.

He said the allegations against Northern Rock Guernsey were not as bad, but nevertheless conveyed a negative impression.

The bank has denied any wrongdoing.

    If they are so aware of the ‘embarrassment’, and I not that that is all it is, why have they let this happen for decades?

    Truth is, that Panorama prog is a little bit more of the stinky cat coming out of the bag and the top dogs are scared.

    We are seen as freeloading scum by the rest of the world, except of course the cosy monied microfraction of the world.

    We’re right up there with Vanatua. Wave those flags!

    Mr van Leuven said. ‘The commission’s position is simple – illegality will not be tolerated, nor will conduct which, whilst not unlawful, brings Guernsey into disrepute.

    Very interesting because ‘tax evasion’ is illegal whilst facilitating ‘tax avoidence’ whilst not unlawful, brings Guernsey into disrepute.

    Looks like the new boy at GFSC has scored an own goal.

    Something that is lawful is ok if morally sound, but not if morally iffy. This seems to be van Leuven message.Wher and who draws the line?

    Or is it Ok until caught out?

    Not sure I agree with this:

    If you watch the programme, John Sweeney says:

    “Northern Rock did tell Tony that he should tell the taxman what he’s up to.”

    In contrast, Lloyds TSB’s advice: “telling them it was of no interest to the bank if they told the tax man about income.”

    A little tempting to tarnish all the banks and offshore ‘tax havens’ with the same brush?

    Being a tax haven brings Guernsey into disrepute globally anyway, apart from with tax avoiders.

    What Mr Van Leuven is really saying is that the GFSC will not tolerate anything that brings Guernsey Finance into disrepute.
