Sacked mum-to-be says it was discrimination

AN OFFICE worker who claims she was sacked for being pregnant is fighting for compensation.

Lucy Campbell, 27, was fired from Augentius Fund Administration in February.

Advocate Simon Geall, representing Miss Campbell, said she had been treated unfairly.

‘Miss Campbell’s case is really very simple,’ he said. ‘I ask that the tribunal finds that Miss Campbell was discriminated against on the grounds of her sex. The written statement of reasons for the dismissal is, at best, inadequate and, much more likely, untrue.’

Miss Campbell was given an employment development review in January, three weeks before she was fired. She scored 58 out of 100.

‘All in all, it is fair to say three weeks prior to her dismissal, there was no justification for even minor disciplinary action, let alone full-blown dismissal,’ said Advocate Geall.

‘There is no credible evidence to justify the respondent’s case that Miss Campbell’s productivity and performance deteriorated so much in a three-week period.’

Soon after the review, Miss Campbell began enquiring about her maternity leave. She was mistakenly given the UK handbook, which said she was entitled to 39 weeks’ paid leave.

But Guernsey employees are not entitled to maternity leave until they have been with the company for two years, which Miss Campbell had not. This had led to confusion.

Ian Randall, representing Augentius, said that Miss Campbell had not been dismissed because of her pregnancy. He said she should have known the handbook she had received was wrong.

The tribunal was led by Caroline Latham, with Peter Woodward and Andrew Vernon as members.

Their decision will be communicated to both sides within three weeks.
