Lawyer may try to get kiosk case reopened

THE Royal Court could be asked to reconsider its decision to evict the tenants of Pembroke Bay Kiosk.
Representing Gary and Lynn de Carteret, Advocate Nick Barnes said he had asked for copies of minutes from the Board of Administration and Treasury and Resources Department board meetings at which the decision to evict was discussed. He also wanted to check whether the decision had been human rights compliant and rational.
If there was merit to further challenge, Advocate Barnes said he might ask the court’s leave to reopen the case.
On Friday, the court found that the Treasury’s decision to evict the de Carterets from the kiosk, which they bought 15 years ago, but which occupies States land, was lawful. Yesterday’s proceedings had been due to determine the length of stay and whether any conditions would be attached. Advocate Barnes was involved for the first time.
The court ordered that the kiosk should open as soon as possible but certainly by 8 May and should be open daily from 10am to 6pm.
The case will be reviewed at the Interlocutory Court early in May.
