‘States should challenge killjoy Cobo gigs ruling’

THE owner of Cobo Bay Hotel wants a court to rule on whether a decision not to close the road for this summer’s balcony gigs was made fairly.
David Nussbaumer (pictured) has taken legal advice and wants a judicial review of whether the decision to narrow the definition of what constitutes a special event was made within the law.
Police have refused to close the road in front of the hotel for free after consulting the Law Officers.
The chief officer decided that events that happened more than once a year should no longer be considered special. Mr Nussbaumer could apply for an alfresco licence but was told that would cost £1,000-plus after legal and other fees were taken into account.
Mr Nussbaumer said he could not afford to take action himself but urged deputies, particularly those in the Castel, to take up the case. He said the definition of special events was a grey area which needed to be cleared up because other occasions could be threatened.
