Electrician wins ‘threat to kill’ dismissal claim

AN ELECTRICIAN has won an unfair dismissal case against his former boss, whom he claimed had threatened to kill him.
Robert Cataroche said electrical contractor Nigel Hunkin made the threat when he fired him over the phone in November.
Mr Hunkin claimed that Mr Cataroche had left N. M. Hunkin Electrical Contractors of his own accord before the telephone call and said he was taking business away from him.
He denied threatening Mr Cataroche’s life.
But an employment tribunal ruled the sacking was unfair. ‘Mr Cataroche was dismissed without any warning or any regard to either a proper disciplinary procedure or the relevant Commerce and Employment code of practice and had been treated neither fairly nor reasonably in relation to the circumstances of the case,’ said chairwoman Georgette Scott.
