Unfair dismissal claim dropped as plaintiff is too late for deadline
Friday 24th September 2010, 2:29PM BST.
A MAN who submitted his unfair dismissal claim a day late has seen his application dismissed.
David Bourgaize, 46, who is dyslexic, said he found out how to claim only some time after he was sacked.
But a tribunal decided that his reasons for failing to get the documents in on time were not good enough to grant him a time extension.
An earlier hearing had heard that Mr Bourgaize had been involved in a dispute with his employer, Drainforce, on 26 February and left the site. He said the Social Security Department refused to give him any benefit because a report from his former employer said the sacking was his own fault.
He was late submitting the tribunal form because he didn’t know his options and was unaware there was a time limit.
