Restaurant manager says boss who claims he is a thief breached employment laws
Tuesday 23rd November 2010, 2:29PM GMT.
A FORMER restaurant manager accused by his former boss of stealing, claims he was used and unfairly dismissed, an employment tribunal heard.
Geraldo ‘Gerry’ Gomes, 34, claims that his former boss, John Carpenter of the Carlton Hotel Ltd, breached employment law by not issuing him with a contract or pay slip in his five months of working at Latino’s and the Wicked Wolf.
Although he believes he was unfairly dismissed, Mr Gomes (pictured) cannot claim for this in the tribunal because he had been employed by Mr Carpenter for less than 12 months.
Andy Castle of Castle Defence, who represented Mr Carpenter, said that CCTV footage proved that Mr Gomes took money from the till and was sacked because of this evidence.
Mr Gomes is seeking £2,190 in compensation for unpaid wages.
A decision is expected in three weeks.
