Death threats follow men’s savage beating

Royal Court building‘TELL the police and I will kill you and your family. I’ll go down for four years but when I get out I’ll be back looking for you.’

That was the threat delivered by one of two men sentenced to a total of more than 13 years in prison for serious and violent criminal behaviour.

Joe de Garis, 24 and Daniel Kaines, 22, who pleaded guilty to three indictments, were jointly charged with assaulting Martin Hallett and Roger Hatwell on 5 June. They appeared for sentencing in the Royal Court and each received four years for those assaults.

Kaines was further charged with attempting to pervert the course of justice, for which he received another 18 months.

    …it would appear that those who have been saying sentencing is not strong enough, in Guernsey, may be correct..”I’ll kill you and your family and go down for four years” seems to be the words of a young man who believes such a crime is on the lower scale of mass murder!

    In addition rehabilitation is simply out of the question, as he “will come looking for you”…

    Dismay, sadness and fear are words that come easily to mind.

    Seems one had already decided how long he had to go down for by telling their victim how long he would get! and then the judge does exactly what he said. Does not seem long enough to me! what happens when he is out in four years. He goes back again to his victim, repeats the exercise, and then tells him long he will get next time?
    Who is running the asylum? (Sorry – jail!)

    On my reckoning the total sentences were 8 years and 5 and a half respectively. The report could be a bit clearer here.

    The fact that I know both the of victims is irrelevant.These criminals should go down for at least 20 years.the same as if it were attempted murder. The Courts are far far too lenient .Perhaps we need a new Judge, possibly one with zero tollerence. If the problem with longer sentencing is with the Law ,then change the Law, and do it now!

    This the same Mr De Garis who not so long ago kept writing to the GP setting out all the ills of the prison system?

    Seems a bit keen to get back in to that bad old place. again. Maybe looking to effect change from within.

    More likely a repeat of his antics set out at page 2 of today’s paper though…

    I dont quite understand, i make it 9 1/2 years 4 each for the assaults (8) plus 18 months for Danny???????
    Either way both these guys (im ashamed to say i know them) have offended many time before and im pretty confident this wont be there last, prison means nothing to them, its a joke all it does is save them going to the social every week, but that doesnt matter because we pay for them on the inside aswel.
    Not sure how accurate i am but Joe started school over hear quite late, having come from the UK so what resident status does he have? If he is on any licence he should be sent back over the pond along with anyone else who assumingly comes hear for a better way of life but choose to make locals life worse.
    As far as the comment made by Danny goes, they will both come out with a chip on there shoulders because they been “grassed” not caring about the fact they broke the law, that in my opinion is where we should all stick together and break idiots like these down before they reofend, ok 2 wrongs dont make a right but clearly prison doesnt matter to them.

    Both co-defendants received 2 years on each count of common assault, to run consecutively to each other; i.e a total of 4 years for the 2 assaults; both defendants then received further sentences for the other offences of gbh and perverting the course of justice.

    Bloggs. Yes you are inaccurate. Not that it is any business of yours but Joe has got a local licence. And please don’t make out this Island is something special.Crime and the rest was established long before Joe came to the Island. And do not forget just how many of your ‘locals’ are sat in prison either. This Island and its short comings has always hidden behind its beauty. It is a ‘What lies beneath’ Island. I have lived here long enough to know that.

    Ajay – As a tax payer its every part “my business” as to what my money is wasted on, i did say i could be wrong regards Joe but i stand by my comment regards people breaking the law whilst being allowed to stay hear on licence.
    You are correct, we do have locals inside, by what you say Joe is another one of them, i dont always believe everyone inside is a bad person but in this case i think there wasters.
    Joe can write to the press complaining about how things should be inside, why doesnt he think about writing a cv and covering letter to give to possible employers when he gets out, he could find a job, actually pay his own way and see how he feels going to work everyday to earn honest money just to see part of it spent on wasters who choose to go around fighting people (and worse) like he does now.
