Prison officer’s constructive dismissal claim is rejected

A PRISON officer who claimed he was left with no option but to resign has seen his complaint of constructive dismissal rejected by an employment tribunal panel.
Senior officer Mikael Appelqvist left his job in February 2010 after returning to work having been suspended for an alleged assault on a juvenile prisoner in November 2009. The matter was referred to police, but was dropped. Mr Appelqvist (pictured) was told he could go back to work, but with no contact with prisoners.
The tribunal found that Mr Appelqvist was not constructively dismissed and that he had failed to demonstrate that the prison had acted in a manner that entitled him to view his contract as breached, therefore enabling him to resign.

I wonder if the tribunal would have come to the same conclusion had it been a company in the private sector, rather than a states department?

The tribunal panel is not made up of States members. They come from the private sector and volunteer their time to hear tribunal claims. Similar to a jury. Therefore no conflict of interest.
