Indecency case thrown out over police ID error

Royal Court buildingTHE case against a man accused of committing an act of gross indecency towards a 13-year-old has been dropped after police breached the code of practice during the investigation.

Judge Philip Robey ruled in the Magistrate’s Court that an identification process had not been conducted properly and the evidence, as a result, could not be submitted at trial.

While the breach had stemmed from an honest mistake, it was a serious one. The defendant, 50, could no longer be guaranteed a fair trial and justice demanded the exclusion of that evidence.

After a one-week adjournment, Crown Advocate Graeme McKerrell said no evidence would be offered against the defendant following the court’s ruling.
