A HOTEL worker who earned less than the minimum wage was unfairly dismissed, an employment and discrimination tribunal concluded.

Anita Guza was employed as a waitress/chambermaid at Auberge du Val from 31 May 2009 to 30 April this year.

Evidence from the parties demonstrated a flexible working relationship. The hotel would accommodate Ms Guza’s additional working commitments elsewhere, while she made herself available to work over and above her normal working arrangements when Auberge du Val was busy.

Mr Andrade submitted five unsigned personnel file notes alleging incidents of misconduct between 2 May 2010 and 3 April 2012.

The tribunal upheld both parts of Ms Guza’s claim. The hotel must pay her £1,648 for the underpayment plus 26 weeks pay at £6,396 for her unfair dismissal. That made the total award £8,044.
