Couple suing States and Lagan over airport build
Tuesday 29th January 2013, 12:00PM GMT.
A COUPLE who say they have been forced to leave their home as a result of nuisance problems caused by the airport runway refurbishment project are suing the States and Lagan Construction.
Ian and Catherine Burnie, whose home is about 100ft from the perimeter fence of the southern compound, in Vue de L’Eglise, Forest, are claiming more than £200,000 for problems they say they have had with noise, vibration, light, dust, and noxious vapours.
The matter will be defended.
In the case placed before the Royal Court, the couple say that they were forced to leave their home in August and move into rented accommodation.
The defendants would argue that the nuisance is not actionable on grounds that the work is for public benefit, said the Burnies, but they said they were not required to bear the cost of public benefit.
