THE sacking of a Guernsey FC player for not performing duties in a hotel health suite showed a ‘substantial failure to follow fair procedure’, an employment tribunal has ruled.
Scott Bougourd, 22, was awarded six months’ pay, equivalent to £5,485.40, by the panel, which deemed he was unfairly dismissed from La Trelade Health Suite by leaseholder Sheryl Batiste on Friday 13 July 2012.
She took over the running of the facility last year and said she was forced to give Mr Bougourd a number of verbal warnings after gym members complained about untidiness.
However, the panel decided that Commerce and Employment’s code of practice for disciplinary practice and procedures had not been followed.
